As the NVMe is empty there are no updates to be considered/missing.Is it possible you already had updates installed? Or using a different image than what I was using?
After finally getting it to work, i redid the process to verify that I saw what I saw.
Only thing that might be different is the Pi5 firmware when starting but as that gets updated when running rpiboot for flashing MSD gadget FW I wouldn't factor that in.
